A
felony
is broadly defined as a crime that is punishable by imprisonment of
more than six months. Generally speaking, felony crimes are
those which are of a more serious nature than a misdemeanor crime,
and are criminal offenses that are either particularly heinous,
involve dangerous weapons, drugs, threaten behaviors, personal
physical harm, or relatively high amounts of financial or property
damage are classified as felonies.
There are five (5) degrees of
a felony crime:

5th degree felony:
punishable by up to a $2,5000 fine, five (5) years community control, 6 - 12
months jail;

4th degree felony:
punishable by up to a $5,000 fine, five (5) years community control, 6 - 18
months jail;
3rd degree felony:
punishable by up to a $10,000 fine, five (5) years
community control, 1 - 5 years jail;
2nd degree felony :
punishable by up to a $15,000 fine, fifteen (15) years
community control,
2 -8 years jail;
1st degree felony :
punishable by up to $20,000 fine,
3 - 10 years jail.

carries the possibility of the death sentence under
certain circumstances in Ohio. Additional prison
time may apply in cases involving firearms, repeat

prison sentences. Felony one and felony two level
offenses carry a presumption in favor of prison
time. Felony four and felony five level offenses
generally carry a presumption against prison time.
Felony three level offenses may not carry any
presumption.
