Spousal support is the money paid to the divorced spouse or to the spouse with whom divorces proceedings are initiated, as compensation ordered by the court, for their support. Spousal support is the legal term which replaced the former term of alimony.

The amount of spousal support which may be ordered by the courts vary on a case by case basis, taking into account various guidelines which are at the courts disposal. The courts sometimes are more generous in the award for spousal support for the first year following a divorce. Additionally, the courts do not simply grant spousal support in every case. In many marital and family law cases, the individual requesting spousal support must show that it is warranted by meeting specific guidelines.

In spousal support requests or disputes the courts will consider the length of the marriage, the parties ages, health status and needs, residential living needs and standards, the occupations of both parties (as well as their income), their vocational skills, essential estate and liability needs of each of the parties, the contributions of both parties to the marriage, and the conduct of the parties during the marriage.

Essentially there are four (4) types of spousal support (alimony):

  • Temporary spousal support: is typically in cases of short marriage duration where a spouse has a demonstrated need and the other an ability and it is designed to assist the lower income earning spouse pending the resolution of the divorce lawsuit;

  • Lump sum spousal support: is a one time payment of a set amount.  It is applicable in a marriage which is not too short but not too long in duration;

  • Rehabilitative spousal support: is typically support designed to assist the lower income earning spouse as he or she travels through their rehabilitative plan, the plan being a formulation of strategies and goals to increase one's earning ability;

  • Permanent spousal support: is in marriages of long duration, typically over 15 years and typically does not end until the payee spouse dies, remarries or is in a supportive relationship by law;

Post judgment spousal support modifications may be requested if during the period that the spousal support court order is still in effect, there are significant changes to either parties circumstances. Modification requests are not typically well received by the other party, and are typically heavily disputed.
